Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Acreate (ABN 48 580 697 259, "we", "us", "our") governing your use of acreate.com.au and app.acreate.com.au (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Eligibility and acceptance

You must be at least 16 years old to create an account. If you are between 16 and 18, you confirm you have your parent or guardian's permission to use the Service and to agree to these Terms. By accepting these Terms you also accept our Privacy Policy and Acceptable Use Policy.

If you create an account on behalf of an organisation (for example, a tutoring company), you confirm you have authority to bind that organisation to these Terms, and "you" includes that organisation.

2. Your account

You're responsible for keeping your account credentials secure and for all activity under your account. Tell us promptly if you become aware of unauthorised use of your account. We use Clerk to manage authentication — your login is subject to Clerk's own security practices in addition to ours.

3. The Service

Acreate helps you generate curriculum-aligned worksheets using artificial intelligence, based on the subject, year level, topic and other details you provide. Available question types, upload limits, and features depend on your plan (see Pricing).

AI-generated content — please review before use

Worksheets, answer keys, and any content produced from an uploaded reference file are generated by an AI model and may contain errors, including incorrect answers, curriculum misalignment, or content that isn't perfectly suited to your students. You are responsible for reviewing all generated content for accuracy and suitability before using it with students. Acreate is a drafting and productivity tool for educators — it does not replace your professional judgement.

Curriculum alignment

We aim to align generated worksheets to the Australian Curriculum (ACARA) and, where applicable, VCAA study designs, but we do not guarantee perfect or complete alignment for any given worksheet, and curriculum requirements can change. Acreate is an independent product and is not affiliated with, sponsored by, or endorsed by ACARA or the Victorian Curriculum and Assessment Authority (VCAA).

4. Subscriptions, trials, billing and cancellation

• Plans. Acreate offers a free plan and paid subscription plans (currently Acreate Family and Acreate Tutor), billed monthly or yearly in Australian dollars, as described on our Pricing page. Enterprise plans are subject to a separate agreement.
• Free trial. New paid subscriptions include a 7-day free trial. A valid payment method is required to start a trial. If you don't cancel before the trial ends, your subscription automatically begins and your payment method is charged the plan price. You won't be charged during the trial if you cancel before it ends.
• Automatic renewal. Paid subscriptions renew automatically each billing period until cancelled. You can cancel anytime from Settings → Subscription (personal accounts) or the organisation billing page (organisation accounts), which opens Stripe's secure Billing Portal.
• Cancellation. Cancelling stops future billing; you keep access to paid features until the end of the current billing period, after which your account reverts to the free plan.
• Price changes. We'll give you reasonable notice before any price increase takes effect for your next billing period.
• Refunds. See our Refund Policy.
• Taxes. Prices may be subject to Australian GST, calculated at checkout where applicable.

5. Your content and our licence to it

You retain ownership of the topics, custom instructions, uploaded reference files, and any other input you provide ("Your Input"), and of the worksheets generated from it ("Generated Content"), subject to the underlying rights of any third-party material you upload (see the Acceptable Use Policy).

You grant us a limited licence to use Your Input and Generated Content solely to operate, maintain and improve the Service for you — for example, storing your worksheets so you can access them later, and sending Your Input to our AI provider to generate content. We don't claim ownership of your worksheets, and we don't use Your Input to train AI models on behalf of third parties.

Portions of the Australian Curriculum referenced by the Service are used under the Creative Commons Attribution 4.0 International licence, © Australian Curriculum, Assessment and Reporting Authority (ACARA) 2010 to present.

6. Acceptable use

Your use of the Service is also governed by our Acceptable Use Policy, which covers matters such as not uploading other people's personal information without authority and not misusing the AI features. A breach of that policy is a breach of these Terms.

7. Third-party services

The Service relies on third-party providers, including Clerk (authentication), Stripe (payments), Supabase (data storage), OpenAI (AI generation), PostHog (analytics) and Vercel (hosting). We aren't responsible for outages, errors, or changes in those providers' services, though we'll work to minimise any impact on you.

8. Service availability and changes

We aim to keep the Service available and reliable, but we don't guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features of the Service (including AI models used for generation) from time to time. We'll try to give you reasonable notice of material changes that reduce functionality you're paying for.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including as to accuracy, reliability, or fitness for a particular purpose. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law (ACL) or any other applicable law. Where the ACL applies and permits us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to resupplying the Service or paying the cost of resupply.

10. Limitation of liability

To the maximum extent permitted by law, and subject to section 9, our total liability to you arising out of or in connection with the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, or for loss of data, profits, or goodwill.

11. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms or the Acceptable Use Policy, if required by law, or to protect the security or integrity of the Service. You may stop using the Service and delete your account at any time (see the Privacy Policy, section 11). On termination, your right to use the Service ends, though sections of these Terms that by their nature should survive (such as billing for amounts already owed, and limitations of liability) will continue to apply.

12. Governing law and disputes

These Terms are governed by the laws of Victoria, Australia. You agree that the courts of Victoria have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where you're a "consumer" under the Australian Consumer Law and mandatory consumer-protection venue rules provide otherwise.

13. Changes to these Terms

We may update these Terms from time to time. We'll update the "Last updated" date above and, for material changes, provide additional notice. Continuing to use the Service after changes take effect means you accept the updated Terms.
